The complete Ontario guide to selling an inherited home

If you are the executor (estate trustee) of an estate with a home in it, this guide walks the whole road: probate, taxes, the vacant months, and the sale itself. Plain language, Ontario law, Durham Region reality. No urgency, and nothing here is a sales pitch dressed up as advice.

Selling an inherited home in Ontario usually means getting the Certificate of Appointment of Estate Trustee first, paying Estate Administration Tax of roughly 1.5 percent above a $50,000 exemption, carrying a vacant home for months, then selling under a duty to get fair market value and to be able to prove it.

Most executors do this exactly once. The court process has its own vocabulary, the tax rules are counterintuitive, and the house itself sits there costing money the whole time. Stage 1

Understanding probate

Probate in Ontario is formally the Certificate of Appointment of Estate Trustee, issued by the Superior Court of Justice. Real property held solely in the deceased’s name generally cannot close without it. Ontario reports processing standard applications in about 15 business days once received, but the real-world wait from filing to certificate commonly runs 2 to 6 months, and full settlement often takes 8 to 12 months.

The wait does not have to be dead time. We plan and scope the renovation during the probate wait, and where your lawyer confirms it is appropriate, approved work can begin so you list the day probate clears.

Stage 2

Probate costs: Estate Administration Tax

Ontario’s Estate Administration Tax is $15 for every $1,000 of estate value above a $50,000 exemption, roughly 1.5 percent; estates valued at or under $50,000 pay none. On an $800,000 estate that is about $11,250. Estates of $150,000 or less may qualify for the simplified Small Estate Certificate. After the certificate issues, an Estate Information Return is due to the Ministry of Finance within 180 days.

Stage 3

The vacant months

Once a home sits empty, standard homeowner insurance can be voided after roughly 30 consecutive days of vacancy, and vacant homes are typically excluded from theft, vandalism, and water damage coverage. Insurers expect the heat maintained or the plumbing winterized. Tell the insurer immediately and get the right vacancy coverage in writing. The good news for Durham executors: Toronto’s Vacant Home Tax applies only inside the City of Toronto, and no Durham Region municipality currently levies one.

Stage 4

Valuing the home: your fiduciary duty

An estate trustee has a fiduciary duty to obtain fair market value for estate property and to be able to show how they got it. The Estate Information Return is auditable and the Ministry of Finance cross-references declared values against MPAC assessments. Ontario courts have ordered trustees to make up the difference personally where estate property was sold below fair market value. A documented valuation trail, before and after any work, is the estate trustee’s best protection. Statements of law here should be confirmed with an estate lawyer for your situation.

Stage 5

The contents clear-out

Clearing a parent’s belongings is consistently the task executors dread most. Durham has established estate clean-out providers, and typical GTA pricing runs a few hundred dollars per half-truck load, more for a full house. We coordinate clean-out, repairs, and sale preparation as one plan, so it does not all land on you.

Stage 6

Selling: as-is, renovated, or a cash offer

Cash buyers target inherited homes with speed and convenience, and industry reporting puts their offers typically at 70 to 80 percent of market value. Selling as-is on the open market is faster but leaves the condition discount on the table. A pre-sale renovation, funded at no upfront cost through Renos for Revenue and repaid at closing, is built to capture that gap for the estate instead.

In one real Durham case, an automated tool valued 132 Winona Ave at about $695,757 as-is. After a pre-sale renovation, it sold for $980,000.

Stage 7

Taxes and distribution

On death there is a deemed disposition of the home at fair market value. Gains to that date are generally paid by the estate on the terminal return; beneficiaries do not pay tax simply for inheriting. But appreciation after death on a vacant home is generally taxable to the estate when it sells, which is one honest reason not to let the property drift. A Graduated Rate Estate has a 36-month window of graduated tax rates, and the capital gains inclusion rate remains 50 percent. Confirm every tax position with an accountant.
