Hinchey Homes Real Estate Team (“Hinchey Homes,” “we,” “us,” or “our”), brokered by eXp Realty, Brokerage, operates the website hincheyhomes.com. This Privacy Policy explains what personal information we collect, why we collect it, how we use and protect it, and what rights you have. We comply with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), Ontario’s Accessibility for Ontarians with Disabilities Act (AODA), and the Real Estate Council of Ontario (RECO) requirements that apply to our brokerage activities.
Important: Sharing With PropTx and TRREB
IMPORTANT: Personal information you provide on this website may be shared with PropTx Innovations Inc. and the Toronto Regional Real Estate Board (TRREB) for the purposes of auditing compliance with MLS® Rules and Policies, including the VOW Rules, and for legal purposes. By using this website, you consent to this disclosure.
1. Information We Collect
Information you give us directly
- Name, email address, and phone number when you fill out a contact form, request a home valuation, or book a meeting.
- Property details (address, condition, timeline) when you discuss a listing or a Renos for Revenue project with us.
- Messages you type into the Hank chat widget on our site. The chat is powered by the Claude API (Anthropic). Your messages are sent to Anthropic’s servers to generate a response and are not stored by us after the session ends. If you share contact information in the chat, it is forwarded to our CRM (see Section 3).
Information collected automatically
- Cookies and tracking pixels. Google Analytics 4, Google Tag Manager, and Meta Pixel collect anonymised browsing data (pages visited, time on site, referral source, device type). These tools use cookies.
- Follow Up Boss widget. Our CRM places a tracking script that identifies return visitors so our team can provide better service.
- Server logs. Our hosting provider (Vercel) records IP addresses, browser type, and request timestamps for security and performance monitoring.
2. How We Use Your Information
- To respond to your inquiries and provide the real estate services you requested.
- To send you relevant property listings, market updates, or Renos for Revenue information. You can unsubscribe from marketing emails at any time by clicking the unsubscribe link or contacting us directly.
- To improve our website, marketing campaigns, and client experience based on aggregated, anonymised usage data.
- To comply with legal and regulatory obligations, including RECO record-keeping requirements and TRREB data rules.
- To detect and prevent fraud, abuse, or unauthorized access to our website.
3. CASL and Anti-Spam Compliance
We comply with Canada’s Anti-Spam Legislation (CASL). We send commercial electronic messages only to people who have given us express consent through a form on this website, a direct conversation, or an existing business relationship recognized under CASL.
Express consent
Every form on hincheyhomes.com that collects your email or phone number includes a clear, unchecked consent checkbox. You must actively opt in before we add you to any marketing list. We do not use pre-checked boxes, bundled consent, or implied consent from browsing activity.
What we send
- Market updates covering Durham Region neighbourhoods including Oshawa, Whitby, Ajax, Pickering and Clarington.
- Listing alerts for new properties that match criteria you shared with us.
- Transaction-related communications tied to an active buying, selling or Renos for Revenue engagement.
- Occasional announcements about Hinchey Homes events, community sponsorships or programs.
How to unsubscribe
Every marketing email we send includes a one-click unsubscribe link in the footer. Unsubscribe requests are honoured within 10 business days as required by CASL, and in practice are processed immediately. You can also withdraw consent by replying STOP to a text message, emailing shawn@hincheyhomes.com, or calling 905-449-4422.
Consent records
We keep a record of when and how you gave consent (form name, date, IP address) and when consent was withdrawn. These records are retained for at least three years after the most recent commercial electronic message was sent, as required by CASL, and are available to you on request.
4. Third-Party Services We Use
We share personal information only with services that are necessary to operate our business. We do not sell your data.

5. Cookies
Cookies are small text files stored on your device. We use them for analytics, advertising measurement, and remembering your accessibility preferences (font size, contrast settings).
You can manage or delete cookies through your browser settings. Disabling cookies may affect some site features but will not prevent you from browsing our listings or contacting us.
Our site shows a cookie consent banner on your first visit. Analytics and advertising cookies are not loaded until you accept.
6. How Long We Keep Your Information
- CRM records (name, contact info, inquiry details) are retained for as long as we have an active client relationship, plus the retention period required by RECO (currently six years after the last transaction).
- Chat conversations with Hank are not stored on our servers after the browser session ends. If you shared contact info in the chat, only the contact record in our CRM is retained.
- Analytics data is retained by Google and Meta according to their default retention settings (typically 14 months for Google Analytics).
- Server logs are retained by Vercel for up to 30 days.
7. Contest Entries
When you enter a Hinchey Homes Real Estate Team contest such as the Find Hank Durham 2026-2027 contest, we collect your full legal name, Durham Region mailing address, email address, and telephone number.
We use this information solely to:
- Verify your eligibility under the contest rules (Durham Region residency, age of majority)
- Contact you if you are selected as the winner
- Mail or transfer the prize to a confirmed winner
- Maintain records of valid and invalid entries as required for contest administration and dispute resolution
- Send you marketing communications, ONLY if you have separately and expressly consented to receive them via the marketing consent checkbox at entry
Contest entry data is retained for ninety (90) days following the end of the relevant Contest Period, after which it is securely destroyed, except as required to be retained by law or by RECO record-keeping requirements.
If you have consented to receive marketing communications, your contact information will be moved into our regular CRM and retained per our standard CRM retention policy described elsewhere in this Privacy Policy. You may withdraw your marketing consent at any time by clicking the unsubscribe link in any marketing email, texting STOP to any marketing SMS, or contacting tara@hincheyhomes.com.
8. How We Protect Your Information
We use industry-standard security practices including encrypted connections (HTTPS/TLS), secure API authentication for all third-party integrations, and access controls that limit who on our team can view your personal information. Our CRM and hosting providers maintain SOC 2 compliance. No method of electronic transmission or storage is 100% secure, but we take reasonable steps to protect your data from unauthorized access, loss, or misuse.
9. Your Rights Under Canadian Privacy Law
Under PIPEDA, you have the right to:
- Access the personal information we hold about you.
- Correct inaccurate or incomplete information.
- Withdraw consent for marketing communications at any time.
- Request deletion of your personal information, subject to legal retention requirements (RECO mandates we keep transaction records for six years).
- File a complaint with the Office of the Privacy Commissioner of Canada if you believe your privacy rights have been violated.
To exercise any of these rights, contact us using the information below. We will respond within 30 days.
10. Children’s Privacy
Our website and services are not directed at individuals under the age of 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will delete it promptly.
11. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of this page. We encourage you to review this policy periodically. Continued use of our website after changes are posted constitutes acceptance of the updated policy.
